Please read these terms and conditions carefully before using the Cushla website and/or mobile application.

These terms tell you the rules for using our website www.cushla.io and Cushla mobile application (together referred to here as ‘Site’).

The Site is operated by Cushla Health Systems Limited (”We”). We are a company registered in Ireland under company number 679593 and have our registered office at 31 Boroimhe Hazel, Swords, Co Dublin, Ireland.

These terms of use refer to our Privacy Policy and our Cookie Policy. By using our Site you accept these terms.

We may update and change our Site from time to.

We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

Whether you are a consumer or a business user we do not exclude or limit in any way our liability to you where it would be unlawful to do so and where such liability is directly caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are a business user: we exclude all implied conditions, warranties, representations or other terms that may apply to our Site or any content on it; we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, our Site; or use of or reliance on any content displayed on our Site; in particular, we will not be liable for loss of profits, sales, business, or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by the law of Ireland. You and we both agree that the courts of Ireland will have exclusive jurisdiction.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the law of Ireland. We both agree to the exclusive jurisdiction of the courts of Ireland.

Cushla intellectual property

Our proprietary technology, innovation and brand assets are protected by international intellectual property rights and unfair competition laws.

'Cushla' is a trade mark of Cushla Health Systems, registered internationally (01849980). Other trademarks, logos, and slogans registered or used by Cushla Health Systems include, but are not limited to, the following: 'Cushla the heartbeat of healthcare' (263633), 'Know more. Live healthier.' 'Navigating healthcare interactions made easier.' ‘A healthcare platform with the customer at the heartbeat.’ ‘Empowering personal health data access.’

Our pending international patents include PCT/IB2022/060757 Healthcare information management.

Our proprietary software, screen displays, graphics, documentation, and other elements are protected under international copyright law and by design rights.

We assert and enforce our intellectual property rights to the fullest extent of the law and our intellectual property portfolio is constantly growing. The absence of an intellectual property right from this list pending update — including a product, service name, or logo — does not constitute a waiver of any of our intellectual property rights.
